You will receive a violation notice if your boiler is not inspected and an inspection report is not filed with the Department of Buildings (DOB) during the annual inspection cycle period.

The inspection cycle is from January 1 to December 31 of the year. You can learn more online or by phone.

If an inspection was not performed during the inspection cycle period, you must pay a civil penalty of $1,000. Payment must be made by certified check or money order, in US dollars, payable to NYC Department of Buildings.

If an inspection was performed during the inspection cycle period and filed with DOB, you must provide a copy of the inspection report and cashed check as proof that this violation was issued in error. Owners may need to contact their licensed professional to get a copy of the inspection report and the cashed check.

Certify Removal of Existing Boiler

If a violation is issued for a boiler that no longer exists on the property, the owner must contact a licensed professional (master plumber or oil burner installer) to confirm the boiler does not exist by completing Form OP49 (Self-Certification for Removal of Existing Boiler). The licensed professional must state on the form how the property is being heated.
